Hearing on Casey's possible probation

When my husband told me last night to write the blog already stating that Casey will not be serving probation, I said no. I have trust in Judge Perry.

Baez started the hearing with a witness talking to the lawyers "telefonically". Yes, that's what I wrote and that's what he said.  Of course, everyone got excited thinking it may be Casey Anthony. Well, no we are disappointed once again. It's Susan Finnegan. Casey's Parole Supervisor. She testified that probation officer Natalie Lewis visited Casey in jail.  Baez made the point through this testimony that Casey was supervised and did probation in jail awaiting trial.  Finnegan said if Perry puts Casey on probation she'll be treated just like any other person.  Baez asked Finnegan if they'd have to take extra security measures. She said it's possible.  And said supervising Casey would be a "unique challenge" She also said Casey's probation was completed 1-24-11. They sent her a letter acknowledging that.

Frank George speaks for the State.  He asked Finnegan what's the purpose of probation. She said to protect community.  Frank George said probation isn't designed to look over people who are already in custody. Baez objects.  George questioned usefulness of probation while someone is still in jail. * I agree* Finnegan explained how often a probation officer would see a person, depending on the level they're on.
Baez done questioning, now Perry had questions for Finnegan. He asked if she ever asked Judge Strickland on his thoughts on issue of tolling.  She responded no. Perry now references case law for attorneys that deal with probation tolling issue.
 Lisabeth Fryer now up for defense. * Ughhh her voice annoys me!* Fryer  argued Casey has actually served probation and order came from previously "disqualified judge." She also argues Strickland was recused. It lacks jurisdiction.   She then reviewed previous cases. Fryer says Strickland's move was a "vindictive" move against Casey. 
Perry has questions for Fryer. He asked if she reviewed the sentencing transcript. She says no, but that she saw the video. Perry has copies of transcript. Hands to Fryer.  Perry looks over transcript, notes it was long before Strickland was recused from the murder case.  Perry confirms Strickland's oral announcement was that she was to serve probation upon release from jail.  Perry asked Fryer what obligation does an attorney have to report probation started if it was in conflict with Strickland's order.
JP: "I will be the first to admit this is not a clear cut issue." Perry asked Fryer for her take on what a judge can do to correct the error.  He asked if the defense knew that Casey began serving probation while in jail even though the Judge determined it should be after her release from jail. She said yes and began stuttering an explanation. He attributes the problem to "scrivener's error"  She says that Strickland is biased. He agrees with her, but says that Strickland said whatever he said before all of these issues came about.  She got very nervous. 
* I still can't believe that thid defense team was able to get Casey free! Again I will say to all who read even those who don't agree with me: THE JURY WAS A BUNCH OF IDIOTS!!! *
Perry again asks if Casey's attorneys had an obligation to notify the court the probation didn't conform with Strickland's oral order.  Perry again said Casey was in jail awaiting trial, not serving a sentence.  Perry said Casey's strongest argument is whether Strickland had jurisdiction to clarify "scrivener's error."  Liz Fryer says this is done. It's over. She (Casey) has served probation. She shouldn't have to do it again.  They then went back and forth on the definition of a "sentence".  Judge Perry says Casey was "erroneously " placed on probation.  Perry says "it is a legal maze."
George then speaks again to the Judge.   He said the State believes that it doesn't make sense for probation to be served while in Jail.  "It defeats the purpose." Said that it was probation in "name only."  George said he thinks there is grounds for Strickland's corrected order to stand.  He said there is no jeopardy issue.  "Strickland didn't change sentence or add. He simply corrected a scrivener's error."  Perry asked  George when did the prosecutors learned written and oral announcements were different, and Casey's probation was in jail.  He said he learned when Strickland filed the latest order clarifying issue.  He never received paperwork saying Casey started or ended probation in jail.
Lisabeth Fryer back up. She argued Casey shouldn't be given what they call second sentence.
Judge Perry says he is well aware of the threats against Casey.  He said he wants to talk with DOC to see what they can do.  Perry says he doesn't know if Administrative probation is the way to go. JP: “If anything could go wrong, it went wrong here.” Judge Perry says if you read court transcripts- it was clear.  Fryer says there was a formal termination of probation from Dept of Corrections.
 Judge Perry said he knows of no other case with circumstances like this.  He called this case "a mess."  We're ending w a sidebar. Feels like old days. Fryer says it's regarding a completely different matter.  No decision today.  Judge Perry gives no indication when he'll rule.

Suspect arrested in dismemberment of Law School neighbor

Lauren-Giddings - law school murder victimA classmate of a Mercer University law school graduate has been charged with killing her. Prior to the slaying and dismemberment of 27-year-old Lauren Giddings, Stephen Mark McDaniel had said he could commit murder and avoid getting caught, according to the arrest warrant charging him with murder.
Police in Georgia have charged McDaniel's, 25, with the murder of fellow graduate Lauren.
Her dismembered body was discovered in a trash bin outside an apartment building where they both lived.
Stephen McDanielMcDaniel had made comments that he could kill a person, but he also provided details about how he could “avoid detection.” The comments were “similar to the facts and circumstances surrounding” her killing. The warrant does not say to whom he allegedly made the statements or when.
Both recent graduates, they lived next door to each other in an apartment building across the street from the school, police said.
Police found Lauren's torso in the apartment building trash bin on June 30. 
McDaniel, who was described as a quiet student, told reporters that day that he helped Giddings' friends search for her.

She was "as nice a person as could be; she was personable; she was always nice to talk to," he said. "I don't know why anyone would do this."



That same day, McDaniel was charged with burglary for allegedly walking into two apartments in the building where he lived and stealing condoms, Gaudet said.


McDaniel had a master key that would open all the units in the building, the police spokeswoman said.
He had been held for a month in the Bibb County jail on the burgularly charges.
Lauren, of Laurel, Md., was last heard from on the evening of June 25 and had recently celebrated her sister's wedding.
Five days later, police discovered her torso wrapped in plastic in a garbage bin beside her apartment building.


Police-sealed the apartment doors of Mercer University law school graduates Ms Giddings and Mr McDaniels. Ms Giddings, 27, went missing in June

Gaudet said McDaniel had a collection of swords, but police have not linked the swords to Giddings' death.
"That was a recreational thing for him," she said.
"We've never made a connection between the two."

As a law student, McDaniel worked briefly for the Bibb County District Attorney's Office, Gaudet said.

District Attorney Greg Winters says Mr McDaniel, of Lilburn, is charged with murder.

McDaniel's attorney could not immediately be reached by telephone for comment.

A Stanley brand hacksaw was recovered in a locked storage closet at the Barristers Hall apartment complex. Lauren's DNA was also found on the saw.

For those that doubt the images seen were actually Casey Anthony, TMZ has released video of Casey.  What I wonder is if this is a plan by Baez to get his clients face and look out there in order for her to change her appearance soon and nobody would think it's Casey. This would make it easier for her to change her looks and adapt to her surroundings.

OC DOC hold a news conference regarding Casey!

UPDATE: Casey will be expected to arrive tomm. between 7am and 10 am. Sources say Judge Perry may issue a stay which in that case Casey won't have to appear.  Casey's attorney's are hopeful a stay will be granted. She will have to show up in person herself and check in with her probation officer.  Probation officers saw her only once while she was in jail.  Baez had said earlier this week that Orange County was basically giving a death penalty to Casey if they make her come to Orange County. 

Judge Strickland in Orlando recused himself from the case on Wednesday. His order did not say why.
Earlier this week, he had ordered Casey back to Orlando to meet a probation officer to start a year of probation.
She has vanished from public view but as you know from my previous blog, she has been spotted in Ohio shopping happily for herself!
Strickland sentenced Casey to probation in January 2010 for using checks stolen from a friend. Corrections officials interpreted the sentence so that she served the probation while in jail awaiting her murder trial. Strickland says he meant the probation period to start upon her release.

 DOC says that if Casey does not check in by 10:00 am tomm. she will have a warrant issued against her.  "If she does not check in by 10a tomorrow, we will notify the court." They have not received any threats as of yet towards Casey, but if they will they will work with local law enforcement.  "I know that it's not uncommon for offenders to serve at least part of their probation in jail.  We are prepared to administer the order of the court."  She said Casey will be treated just like any offender and her public records will be entered into public database.  Therefore all her information will be there for anyone to view. If there is a threat, a determination will be made at that time, depending on the threat.  In some cases, offender addresses can be kept private.  Offenders must also have a job and must show that they are looking for a job.  She will have to appear at her probation facility once a month and they also do check her residence.
Casey must provide an address and it is her responsibility to find a place to reside. Social Services are available if she needs them.  Nobody knows who her probation officer will be until she comes in. That depends where she will serve her probation.  If she wants to serve her probation at another state, DOC has to contact the other state and deal with them. "It is not an overnight process."  She will have to qualify for this type of probation.

"The DOC made no mistakes in this case. We do whatever the courts want."  She cannot have a firearm, she has to be employed, random drug testing will also be held. 
Her attorneys have been cooperative and "very nice""They have assured us they will be here before 10 am tomm."  If new information is known , DOC  will update the reporters as the day goes by.

So there you have it guys! Seems like Casey will have to serve her probation and most likely in Orange County.

Is it or isn't it?

So this morning new pictures of Casey were released on TMZ.com. It's pictures of her shopping and walking in Ohio, where she originally is from and where she has family.  Many people are actually in doubts whether this is really her. They cite her weight gain and her "birthmarks" on her cheeks! Also, she is seen texting. People say Casey wouldn't be texting anybody since she doesn't have anybody!
First of all, weight gain? Really?! This wouldn't be shocking seeing as now she has food coming and going as she pleases as well as drinking Coronas whenever she wants!
Second of all those aren't "birthmarks"! Do people not remember her pimples on her cheeks!?
Thirdly, the texts! Baez, family members! Hello! Her safety! 
She has also added green contacts to her look.  If you look at her waist it also is very similar.































Any way here are the pics and some that I placed where you can see her stance when she is walking. Also in one at Old Navy, she is taking the big gulp of air that we have seen her do many times in court. You make the call.

Will Casey get lucky again?

Judge Stan Strickland just signed court documents this morning that will require Casey to serve one year of supervised probation as he originally intended back when he sentenced her in her check fraud case.  


Dept. of Corrections spokeswoman also said she (Casey)  must report in person in Orange County with the next 72 hours.
Strickland said on Thursday that his intention in sentencing Anthony last year was that she should go on supervised probation if released from custody. But state Department of Corrections officials interpreted Strickland's order as meaning that Casey Anthony could serve her probation while still in jail awaiting trial.
Don't know how, since when you listen to him state the order it is obvious that he meant upon her release from jail!
 The state attorney's office spokesman said the Department of Corrections policy allows defendants to serve probation while still in jail and not under sentence.
"I read the order," said state attorney's spokesman Randy Means. "The order said she was supposed to begin when she was released from her sentence."The Dept. of Correction's terminated her probation on Jan. 24 and allowed her to leave the Orange County Jail on July 17 with no restrictions following her acquittal at trial in the murder case last month.
It's likely Casey's defense team will challenge this turn of events, and say that she should not serve probation because she already did that while in jail. An argument claiming "double jeopardy" is expected.
Casey IS the devil
If that happens, the defense would have to make that legal argument before Orange-Osceola Chief Judge Belvin Perry in some kind of emergency hearing.

Honestly I agree with my husband when he says that this BEAST keeps getting luckier and luckier and believe that she did in fact make a pact with the devil!
