Casey Anthony = Susan Smith?

Susan Smith (South Carolina) was sentenced to life in prison for murdering her two sons, 3-year-old Michael Daniel Smith, born October 10, 1991, and 14-month-old Alexander Tyler Smith, born August 5, 1993.  She was convicted on July 22, 1995

Casey Anthony (Orlando, Florida) was charged with killing her 2.5 year old daughter Caylee Marie Anthony with chloroform and duct tape. She was found Not Guilty on July 5, 2011.

 Smith's case gained worldwide attention shortly after it developed, due to Smith claiming that a black man stole her car and kidnapped her sons. Smith later claimed that she suffered from mental health issues that impaired her judgment.

Anthony's case gained worldwide attention shortly after it developed, due to Casey lying about Caylee being with a nanny named Zanaida Gonzalez Fernandez and not reporting Caylee missing for 31 days while she went clubbing and shopping.  She later claimed Zanny had kidnapped Caylee.  Then in court claimed that Caylee had drowned in the family pool.  Casey blamed sexual abuse and a BIZARRE family life impairing the way she would react to her daughter's death.

On October 25, 1994, Smith initially reported to police that she had been carjacked by a black man who drove away with her sons still in the car. Smith made tearful pleas on television for the rescue and return of her children.

On July 15, 2008 31 days after Caylee was last seen, Casey was confronted by her mother, Cindy Anthony, and  reported to police that the nanny took Caylee against her will and that she decided to look for Caylee through other means which she herself claimed was "a stupid thing to do" Searches were immediately started to find Caylee and Zanny.

It later emerged that investigators had been suspicious of Smith's story from the beginning and believed she had killed her own children. From the second day of the investigation, the authorities suspected that Smith knew where the children were.

In the Case of Casey Anthony, from the second day they spent with Casey, investigators knew she had been lying when she took them to Universal Studios in Orlando, Florida and  claimed to work there. Apparently she had been telling her whole family she had been working there for a few years and finally confessing to authorities she wasn't working there.  There was also a scent of decomposition emanating from her whole car.  At this point, law enforcement knew she was lying.

Lakes and ponds began being searched, even the nearby lake in which the children were eventually found. The reason for not finding the children earlier is that the authorities thought the car could have traveled out only about thirty feet and that was the extent of the search.

The areas near the Anthony home were searched and a meter reader, Roy Kronk, found Caylee's remains less than a minute 10 sec drive from the Anthony family home in a wooded area. The reason why the body had not been found earlier was because the area had been flooded.

It was disclosed in her trial that Smith was molested in her teens by her stepfather, who admitted that he had molested Smith when she was a teenager and had consensual sex with her as an adult.

Casey claimed to have been molested by her father, George Anthony and her brother, Lee Anthony and her defense used this as an excuse for her actions and not thinking straight when she knew her daughter was dead.   Though this was never proved.

Smith's alleged motive for the deaths — to dispose of her children so that she might have a relationship with a wealthy local man who had no interest in a "ready-made" family

Anthony's alleged motive for Caylee's death-to be free to date her many boyfriends and party with out worrying about Caylee and who was going to babysit her.
 

What's strange about these two beasts is that they don't seem to care that what they did was wrong. They seem to be in their own world as if they had the right to continue their lives and steal the lives of these beautiful children.  They both seemed to be caring mothers who turned out to be cruel, lying, manipulative monsters who would hurt anyone in their family with no remorse or guilt, for the simple reason of their freedom.

Day 32 Will Casey Testify?

Police presence is strong, spectators were not allowed in at their normal times and ALL 3 Anthony's are testifying today! What type of excitement will happen today. Krystal H0lloway aka River Cruz, George;s alleged mistress had been seen yesterday waiting to testify. Will she today?
Housekeeping
Baez says this morning he was just handed Cindy's work records and 231 pages of printouts.  Baez says he was given phone logs, computer report from state this morning from Gentiva (Cindy's former employer).  Complains that it's a discovery violation and would like to depose the new witnesses and subpoena other days.  Judge says that they'll later look at whether it's a discovery violation and, if so, whether prejudicial.  Judge: Whatever witness you wanna talk with, can depose them after 5:00 today if want to see what they will say.  He also said :if one person says they are in A and not in B, it's logical that someone will try to find out if B is the truth.

Uses River Cruz as an alias because her father used to call her "River" and her mother's maiden name is Cruz.  Met George at a tent when Caylee was missing in August 2008.  *Cindy struggling to be able to see her through spectators heads. George seems nervous and cracks his fingers*  Admits she had an intimate relationship with George.  He went to her house around 12 times.

Looks at jury when tells them that she had a heart to heart conversation with George. He was on couch. Said it was "accident that snowballed out of control." Said it was around Thanksgiving time.
KH: I told him I didn't think he could raise someone who would hurt her child.and that's when he said it was accident that snowballed out of control. Says relationship ended at 4th birthday balloon release.
She says police contacted her 2 years later. They asked if she knew George and if she had an affair with him. She says police had text msg's.  Holloway gave LE her phone and letters that George had written to her. 
Holloway read text from George on Dec 16 "Just thinking about you. I need you in my life."  KH: He didn't show up when supposed to after memorial, didn't call, upset that she was "good enough to sleep with but not call.Her sister sent him a rude message and she never heard from him after that.  Holloway says she informed guard gate not to let George in to her complex.  Baez asked Holloway if media was hounding her.-Sidebar 
When first asked about affair she denied it. She didn't want to get him in trouble.  She was scared and embarrassed. She didn't want media to find out. She was in a relationship when she was with George and when she told LE.  Finally told LE the truth after they saw the text messages. She was confronted by LE.
She was confronted by LE.  Gave interview to tabloid because they let her tell her complete story and not edit things to make her look like trash. Her twin sister got paid for the interview.



Cross Examination
Says that at the time of her meeting with George the Anthony's were well known. JA: "By time you INSERTED yourself into Anthony's life they were already celebrities, weren't they? You sought them out. KH: That's correct.  She gave interview to National Enquirer who paid and not others that weren't going to pay her. She felt NE was the only tabloid that would give her honest testimony. Holloway says her family was paid $4000 to talk with National Enquirer. JA: You felt National Enquirer was the one source you could trust to tell your story in fair, honest, non sensational way? KH: Well, he did JA: "You do agree story is much sexier that you're having an affair with George than just a friend? She says she DID have an affair with him. Sidebar when asked about letter George sent.
Holloway was in relationship similar to a marriage when seeing George, she said.  Sent letter to her stating her relationship was special to both him and Cindy and he even referenced her daughter and "husband".  JA: In letter, did he reference your being a friend to both him and his wife? Send letter signed by both of them? KH: Yes.  Ashton reading deposition to Holloway. She said not having affair under oath in Feb. 17, 2010.  Holloway says her sister went to Media with story.
*She is clearly lying on stand. Getting nervous and leaning forward on her arms.*  KH: In Feb when I told detectives, my sister went to media with it, so I spoke to LE and told them truth within a couple days.  Holloway cannot remember date when she changed her story.  Thinks she changed story that same week of depo. JA: Your sister goes to media with story...when does National Enquirer contact? KH:Don't remember. JA: How did contact with National Enquirer relate to changing story? KH: I had to change my story because the story had come out. I wanted no part of media.* In sidebar Krystal leans head on hands and starts to pick at her face.*
JA: What George said to you was, "I believe it was an accident and she tried to cover up?" KH: No, he did not. *She is trying not to cry*  Ashton reads statement she originally gave to police. In it she said George said Casey tried to cover up accident.He believes it must have been an accident. She reads from statement: "He said that 'I really believe an accident, went wrong, she tried to cover it up."JA: George never told you he was present or knew that to be the case? KH: George did NOT say he 'believed' it.  Holloway shakes her head no on the stand. Ashton asks if George told her he was there during "accident." She says he didn't say that.
Sidebar (5) called during Holloway's testimony re: George allegedly pushing Casey against wall. * she removes her blazer*

Holloway on redirect agrees her statement was taken out of context.  JB: He told you while he was telling the world [Caylee] was missing, that is was an accident. KH: yes.  I never went to anybody. [Detectives] came to my door.  Holloway states she does not have a criminal background.* Shakes her heads annoyingly when Ashton objects*  JB: Why did you go to Enquirer? KH: Because I didn't want story to be edited. He gave me chance to tell story in full.

Holloway cries as Ashton approached her on the stand.  Ashton asks her to read statement from Feb. 17, 2010.
Ashton had Holloway reading her statement in Depo where she quoted George as saying " I really BELIEVE it was an accident"
Holloway in statement said George said: "I never thought it would escalate to something so big."Agrees he never said he had anything to do with Caylee's death and that he believes Casey tried to cover it up.

Before jury entered from break:
JA: Stipulation for jury that Holloway testimony only offered in ref to George testimony, not to be considered for way Caylee died. Holloway statement is no proof of how the child died.  JB: "That's what this is. Just more blah, blah, blah, blah, blah"  Judge says it's evident an instruction needs to be given to jurors.  JP:"We have two trained lawyers that can't even agree as to what the motive may be or may not be.  How can we expect the jurors, who are not trained lawyers, to understand it?"
Baez wants some modification...wants the part about "can't be considered as proof for how child died" taken out. Ashton pointed out that George has been impeached plenty enough already-defense didn't use it for impeachment. JA: Significance isn't really to impeach George but to put before jury in hopes they take it for more than it is.  Baez argues instruction means jury should all but disregard what Holloway said.  JP: "They can believe or disbelieve Mr. Anthony, or any other witness. He says he will give instruction that includes language saying can't use as proof of how child died or Casey guilt/innocence.  "Even the lawyers can't agree what the law is or what it means. I am charged with that responsibility." Baez said language judge added puts defense in worse position than state's proposed language did. Perry said instruction will be read as is. He said if he did anything wrong- he'll be graded later if it comes to that. As in appeal.

Baez asks if he is showing witness a Google map. Dominic says: "Yes sir. Like I pulled up a google?"
Baez wants to talk again about where exactly he searched in the woods (Suburban Dr) a month before Caylee's remains were found.  Dominic Casey points to areas on the enlarged map.

Cross Examination
Casey says he sent map to psychic. He is trying to show (by best guess) where he went into woods.  The map has pins marking location. Dominic Casey marked it the day he searched area (3 years ago).

Video shows a closeup of Henkel brand duct tape.  * So what? Yes, it was in the house and Casey used it! She got rid of it! ASK HER WHERE IT IS!!!!*
George Anthony
Asking George if duct tape seen in video from search command tent was his. George saw video. He says it could have been someone else's duct tape.  Says he doesn't know where video was taken.  Baez gives address. George says it wasn't that location.  JB: "Sir you didn't recognize that location as being close to your home?" George said command center at Publix not at John Young Parkway.
Sidebar (9) called during George testimony about dog named Mandy in Ohio. Henkel tape is produced in Ohio.  GA: Yes, dog named Mandy. Dog had to be put down. Baez is asking how dog was buried. George brought dog home - wrapped a blanket around it - put it in plastic bag.Baez asks if Duct tape used.This happened before Casey was born.  George says he doesn't remember. Says it was 30 years ago. Next questions are about dog named Bo.  Baez asks if Bo was buried in bag, blanket and wrapped in duct tape.  Casey was 4-5.  JB:  Was Penny the cat buried same way? Ginger the dog? Cinnamon. Misty?  George says no dog by that name.  Baez asked if when George found how Caylee was found - did he tell law enforcement that's how he buried pets? Obj- sidebar
 Sustained no more questions.

Cross Examination
JA: Mr Anthony, have you ever taken a dead pet and thrown it in the swamp. GA: No Sir. Excused. He glares at Baez when walking past him.

Cindy Anthony
*Again repeats the words "So help me God, Yes" *
Talks about how Mandy died and buried.  
Cindy says Mandy (dog) was her first baby. When she died,  vet wrapped dog with blanket and black plastic.  Cindy says vet prepared dog Bo for burial. Was in black plastic with tape.  Lee was in 1st grade and Casey 4 years old.  Cindy is explaining how other pets were buried. Almost all had something like towel or stuffed animal and then wrapped in plastic.  CA: Put Penny the dead cat in 2009 in a bath towel then in plastic bag, then packing tape, then buried.Baez asked if she ever told him she used duct tape to wrap pets? -Sustained

Cross Examination
Did not euthanize pets with chloroform. Sustained.  Asks if duct tape was put on nose and mouth. Cindy: no  Burdick said Casey a senior in high school and she helped in wrapping dead pets at the time.  Cindy said burial procedure was a family tradition.  Cindy said tape placed on top/bottom of bags to keep things from coming out.  They would mark spots in yard. Walks down and does not look at Casey.  Cindy kept emphasizing how they put "special" items with the pets. Like "special" items with Caylee, I suppose.


Lee Anthony 
Baez asks Lee Anthony if he remembers Mandy dying. He does not. *Where's the sexual abuse Baez?!*  Lee Anthony remembers Cinnamon in black plastic bag and duct tape used to secure bag.
Basically said mom and dad were responsible for burying dead pets.


 While court went to lunch, Casey beckoned for someone in the gallery to come over to her. Eventually after lots of speculation everyone found out that apparently it's another attorney.

Casey herself says she doesn't want to testify.  Casey wishes to NOT testify, she tells Perry.  Judge asks Casey if it's her decision not to testify. She replies, "Yes sir." JP: Understand solely your decision? CA: Yes.
The jury now knows the defense is ready to rest. Stipulations are being read to the jury.  Will offer business records of Henkel duct tape.

Defense Rests on Day 32!  State said rebuttal case will take less than a day.

Judge addressed defense's claim of discovery violation for material from Cindy's prior employer. Mason argued Gentiva records for Cindy's employment. CM: State knew it was Cindy who made those computer searches and waited to subpoena records now.  He says the defense is prejudiced by the violation. 
Burdick said they are only seeking to introduce 1 page into evidence - also deleted emails from Cindy's work acct. She said they have log-in/log-out record for Cindy for that week & docs showing deleted/sent/rcvd emails from those 2 days Cindy claimed that she did not work.
 State wants to blow holes in Cindy's claims she did computer searches for chlorophyll/chloroform.  Gentiva's John Camperlando (Executive) from Atlanta ready to testify, Burdick said.  CM: "This is not to be a trial by ambush."  Mason says in all Cindy's depos and releasing of discovery never did they bring up witnesses claiming Cindy falsely testified. CM: You must not reward the prosecution and support prejudice in capital murder case. 
Perry asked about Cindy's depo showing times she was working. LBD: We spent majority of inquiry on computer searches on chloroform. 
 Cindy said she only searched chlorophyll. JB: Not complete response. Cindy also mentioned chloroform and ingredients. Sims has started to review documents at lunch but not ample time. JP:  When did you get records? LDB: Yesterday afternoon. JP: When did you notify defense & provide copies? LDB: Yesterday morning.  JP: is this an issue State of Fl knew when they took depo? LDB: I did not anticipate she would dispute the accuracy of her work records so extensively.Cindy said she only searched chlorophyll. JB: Not complete response. JB: Severely punished  because we'd be presenting false evidence and defense certainly didn't knowingly do so.  JB: If we call her on sur-rebuttal she might take 5th. It's way too late, close of case, we've rested.  We don't want stigma attached to defense that we're submitting false testimony.  JP: Unfortunately counsel can't rely upon what witnesses will tell them.  Counsel cannot predict if witnesses will go south with their testimony.  Judge Perry said this may cause all of her testimony to be stricken.  Baez said this is, "No simple issue." Said they will need to have their own experts look through these documents just handed over.LDB: I would never argue JB was trying to dupe jury. If any prejudice at all, can be cured by Baez talking to witness. JP: When Cindy took stand, did you know she was gonna say home vs. work? JB: Yes. JP: You knew she would testify that work records were meaningless? JB: Yes, sir.
Perry rules no discovery violation. State will be allowed to present work records to jury. Baez looked down and pressed his lips together. JP:"Trials are supposed to be about a search for the truth. Juries are supposed to be given sufficient evidence."  Judge says he will instruct jurors about credibility and weight of people's testimony.
Judge says in fairness of the defense he is going to give them rest of day to talk with man from Gentiva.  JP:"I don't think it's any big surprise that somebody wasn't going to to go out and get these records. " The man has a prior engagement (doctor's appt.) but Perry says he will make him miss it.  Perry wants to know more about witnesses medical concurs. Can he miss appointment or come back to Orlando etc. Sims left to interview witnesses and Cindy followed with her lawyer.   Court is currently at ease.
Ashton wants to pass can (smell) around and give jurors option to smell it if they want to.  Ashton wants to rebut defense witnesses who testified the smell in car was trash not decomposition. Second rebut witness will testify as to its authenticity.  JA: I can't find anything that would prohibit jurors from smelling evidence if they want to. Each would have to smell it, though.JB: Nothing Ashton presented gives guidance to court that for first time in FL, jurors should smell and become lay witnesses. JB: Appears Ashton didn't understand your instruction in jury selection and would have to provide case law, not from CA/Guam.

 Judge cites case laws and tells Ashton to sit down.  "I'm not done talking."
 JP: that would violate Casey's due process rights and 6th Amendment rights. Judge will not allow smell tests nor the expert to talk about the can.

Someone just stuck middle finger at Ashton. Taken away by deputy.


*Storm action is intense over here in Florida! God doesn't seem too happy with Casey! I keep looking at the flag outside my window to make sure it doesn't rip off the side of the house. Yesterday had a blackout and lost everything in my blog! Thank goodness for note taking *

 Photos introduced into evidence. No other questions of the witness. Not clear what photos show, other than clothing.
Burroughs identifies photos she took of clothes collected during a search warrant. She says they came from Caylee's room.

Judge is allows photos/docs to be entered into evidence before the jury
Now, officially, the suicide letter is introduced into evidence. The jury takes their time and reads all the pages of the letter  *Later blog will have transcript of letter*
Total silence as court reads letters.
"I cannot be strong anymore." he says he misses Caylee Marie so much. He writes "I want my family back."George (in the letter) writes he got a gun to scare people. "Sure that will not bring Caylee Marie back, but was Casey threatened? I miss her. I miss her so much. I am worried for her. Her personal safety is always on my mind"  He writes "Cynthia Marie you have always deserved more...."I sit here empty inside for her."  He ends the letter with "Caylee here I come. Lee, I am sorry"

Casey just looks at letter and Ashton. Sims asst. keeps talking to her.  The Anthony's are not in the courtroom.

Judge excuses jury and tells them they will begin deliberating on Sat. afternoon.  Sat. morning the court will hear closing arguments.

Anthony's return. George wipes tears.
Perry takes up some other issue. Asked deputy for photograph. Talking to court spokeswoman.

A man who put his middle finger up earlier in session is in front of Judge.. Matthew Bartlett is 28 Years old. Judge Perry is showing Bartlett pictures. It's pictures of him putting up his middle finger.  This young man flipped off Ashton during lunch. Told the Judge it means the "F word" Perry dealing with him now.  Has only graduated HS. No further. JP: "You see this sign? Can you read and write?"  Bartlett said he read sign on door that said no gestures in court. JP: "Was there anything about that that you did not understand sir?"  Perry asks why he shouldn't he held in contempt of court. He apologizes. He says it was something stupid. JP: "There was a reason why you decided to extend Mr. Ashton the courtesy of extending your middle finger. What did he do to deserve the middle finger?"

Kid says he's a server at TGIFriday's at Millenia Mall. Perry asks if he realizes FL taxpayers are spending a lot of $$$ and his actions put everything that's happened at risk.  Perry says his actions could have jeopardized all the work attorneys have done.
Perry finds him guilty of direct criminal contempt and sentences him to 6 days in jail. Deputies put him in handcuffs. $623.00 fine. Judge Perry made him explain all his financial information and gave him a public defender for appeal.  *That's what happens when you let someone see you flipping the bird. That's why we hide it! LOL*
6 days in jail and $623 fine of guy who gave Ashton the finger in court. Taken away.
Jeff says out loud, "What did I do?!?!"

Baez wants a subpoena for Gentiva records. Perry grants motion for subpoena.

So when are the psychics coming? Did they fortell another short day like today!!!!!

So honestly ever since I heard psychics would be taking the stand, I have been waiting and waiting for them to show up. What are they going to testify to? And how is this going to work with the jury. WIll it backfire? Will the jury will finally establish that the defense team is a joke? Hey, here's an idea! Let's ask the psychics if Casey will be found Guilty or Not Guilty

Court started earlier than usual due to housekeeping matters. Jeff Ashton said he was just handed material from defense. Apparently Dr. Furton is going to testify about something else not in his report-AGAIN with this defense?  Baez says "State is incorrect." Judge asks if 1. Has his opinion changed? 2.Did you supply supplemental report? Baez says no new opinions.  Apparently, the witness would testify about chloroform and would list amounts in his PowerPoint presentation.
 Both sides are very annoyed with each other.  Judge Perry: "Somebody get me a copy of the gentleman's report."  Baez says "We're not going to go through this." They will tailor his testimony.
JP: "Gentlemen, I don't know. The only thing I can do is read his report, read his deposition, and see if he has changed any opinions. You'd think this would've grown old by now. But I guess some things never change."  Makes you wonder what was in report that Baez doesn't want Judge Perry to see.
Mason called for a sidebar and Casey along with defense attorneys left with Judge to his chambers. This lasted an excruciatingly long 13 minutes!  Still waiting for Judge while defense talks to prosecution.  Now they have all gone into Judge's chambers minus Casey.   Casey then left with another one of her minions named Michelle Medina.   After 16 minutes Casey finally entered courtroom.  After 18 minutes attorneys returned, then left again.



*personal note: the picture that was shown to Cindy yesterday of Caylee opening door is getting alot of attention. Apparently many people don't think it's an actual picture of Caylee. People are disagreeing with her height. Cindy did testify that it was her however.


That took 23 minutes!  Both sides have come to a conclusion that a legal matter has occurred. The judge did say it has nothing to do with Defense expert Furton (who knows if it does) and court will be in recess until 8:30 Monday morning.  Casey leaves smiling and laughing.  The good thing is that Casey will spend day in jail instead of in court.

Are we going to hear more lies in Courtroom 23 today?

Yesterday we were all shocked when Cindy lied on the stand to save her daughter, so I'm wondering what if any lies are we going to hear today.



 Yesterday Baez asked for a sidebar as soon as court started and today when Judge Perry entered Baez had some matters to deal with first among the defense team. Judge Perry did not seem pleased and reminded them that this was why he asks them to be in at 8:30.


Cindy Anthony
Baez says he wants to talk to her about the shorts found at remains site. You said shorts no longer fit her?  CA: I testified that last time I saw her, she was in 3T size.   Baez is trying to prove that Caylee would have put on those shorts because she wouldn't be aware of sizes. Baez asked if Caylee was growing fast; Cindy said yes, very fast.   Baez wanted to show a video of Caylee. SIDEBAR -2 minutes in
It's the video of Casey lying on the floor playing with Caylee. She's putting Caylee on her knees like she is flying.  Cindy wiped her eyes with a tissue. She says she's watched it hundreds of times.  JB: Why do you believe that was taken early 2007, aside from Caylee's size? CA: I've watched it 100s of times. CA: Photos of me holding Caylee same day. I was wearing a Hawaiian skirt that I didn't wear after because it wasn't popular any longer.  Baez shows photo to Cindy now. She says it's her backyard swimming pool. JB: Is that what looks like w/ladder connected? CA:yes JB: Does the ladder disconnect? CA: Yes. Baez asks her to telestrate how it's removed and she marks area where lifts off hinge.  A new picture shows Caylee climbing ladder. Cindy is behind her helping her.  Cindy says Caylee could climb into the pool by herself. Cindy says she would stand behind her for safe keeping.  Next pic is of Caylee about to step into the pool with Cindy climbing up ladder behind her.  Cindy is crying talking about next picture. It's Caylee getting into pool. Her feet are in the water. Caylee is wearing a life jacket.  Caylee would swim 3-4 times/wk, Cindy said, and she always wore the life vest.  CA: For most part, she'd wait for us. As she got older, would get more anxious to get in. We always had a life jacket on her.


Cindy says they taught Caylee they had to be with her if she wanted to go into pool. Life vest stayed in back patio.  The next picture is Caylee opening glass sliding door- she is alone. She is wearing a little summer dress and tennis shoes.  CA says there was no bar on the sliding glass door. JB: Could Caylee open doors easily? CA: Yes, she could.   Casey wiped away tears as photos are shown.

Cindy says Caylee never left home without shoes. Cindy says she liked to wear shoes. *Personal note: If Caylee loved wearing shoes, wouldn't she still wear them if she went out by herself. She would have attempted putting flip flops on I would assume. * June 16, 2008 is the day the defense claims Caylee drowned in the pool.  Cindy said that the ladder was up, door was unlocked, and side gate was open when she came home from work.  She mentioned this to George and people at her job.  When Baez asked if they were having marital problems 4th sidebar was called and judge asked for "special recess" for jury.  Court in recess for 25 min smoke break.

Before Jury entered:
Judge: What is your defense? You can't use broad blanket of defense to get any and every thing in.Judge: That's why I admitted photos of Caylee climbing into pool, based on your opening. If your theory is ever-changing,maybe somebody needs to explain to me what your theory of defense is."

The judge wants to know because he has made decisions about admitting evidence based on what he believed to be def theory, in part the opening statement.


*Lee is in courtroom sitting next to George. Casey is staring them down. Looks crazier than normal!. Judge Stan Strickland is in the courtroom as well. He was the first Judge in this case.*


Cindy has been wearing purple these past two days. This is what I found out: People who like to consider themselves different from the common herd or unconventional often prefer purple.  It is also a color meaning solidarity.


Jury Back. Cindy on Stand
JB: On July 16 2008, tell Melich about ladder left up on pool? CA: Yes. JB: Within 24 hrs of calling police? CA: Yes.  JB: How many times advised LE you thought Caylee drowned in pool? Objection. Sustained.  JB: Was this topic you constantly brought up with LE? LDB: Same objection. Judge: Approach sidebar. (he didn't sound pleased)

Cross Examination:
Talks about maintaining bedroom and birthday presents for Caylee when she was missing. Also talks about clothes being sold or stored when Caylee outgrew them.  Caylee switched from diapers to pull ups in early 2008. She was potty trained but still carried diapers around when they went out.  LDB shows a picture from the video that shows Caylee wearing a diaper or pull ups.   CA: Looks like pull-up or diaper. LDB: You say she was wearing those shorts in April 2007? Yes.  Hands photos to Cindy and asks if she recognizes those tags on clothing. Circo is a Target brand where they would often shop. Cindy did the laundry most of the time.  Recognizes them to be tops and one pair of shorts. She recognizes them from Caylee's room. They were there in June 2008 and stayed there until seized by LE.    LDB: What size clothing in Caylee's drawers? CA: I had 2Ts - those photos depicted 2Ts but I had 3Ts as well.  Prosecution says that Caylee thinned out as she grew older. Cindy agrees.  

*Any mother knows that sometimes clothes will fit even though the size would be smaller. My daughter up until recently wore skirts that fit her when she was 2 years old. She is currently five!*  

Several pieces of clothing through Caylee's life that weren't kept in my house every day. LDB: Because packed in bag, backpack? CA: Correct. LDB: You have knowledge of diaper bag/backpack being placed in car when you took Caylee out to have change of clothes? Yes   LDB: When was last time you saw those shorts? CA: Those weren't shorts I dressed Caylee in much, not 1 of my favorite outfits. Unless Casey had her in them, I don't recall seeing Caylee in them after 2007.

*Personal note: Maybe Casey put them on Caylee to show a message to Cindy. "You don't like them? Well here! I'll kill her in them!" *

Prosecution mentioned that ladder was heavy and sliding door would take some strength to open. Cindy agreed and said that Caylee was a well behaved child and listened to them. Cindy says gate would not have been able to be opened by CayleeLDB: You testified finding ladder week prior to gas can incidents? CA: Yes. LDB: You said it's 16th, 17th? One of those two days.  You called George? CA: Yes. LDB: You had to call him on his cell phone?CA:  He had work phone, too, sometimes called that.  LDB: Did you leave msg or talk to him? CA:I spoke to him, but not sure after I left a msg.  LDB: As to June, you acknowledge you've made errors. Specifically, in your sworn statement to LE, date last saw Caylee wrong? CA: Yes.  Prosecution asks if that week she worked everyday. Cindy says yes. LDB asks if she is sure. She answers she is sure.  Casey continued to assert that child was kidnapped by babysitter. Cindy agrees.

Shown the same photos that Prosecution showed with clothing tags.  Says they didn't sell all the clothing that Caylee had outgrown . She agreed.  JB: Shorts Caylee found in were jean material? Cindy: A cotton type material. And knit is stretchier? CA: Absolutely. JB: Custom to go looking for clothes that didn't fit her anymore? CA: At certain times, like Christmas, holidays.  Cindy was not overly strict with Caylee. Cindy thought she was above average.


Nobody looked over at Casey while stepping down or while walking up


Lee Anthony
Baez asks if he owned Sunfire at one point. LA: Yes, 2000-2005.He starts circling stains in trunk of car using same photo Cindy was shown yesterday.  Stains were there since he bought car.  He doesn't remember staining car, but he could have throughout his time owning it.

* Casey looks at him and tries to hold herself from "crying"*

JB: When first time you noticed Casey pregnant? Ashton: Objection. Sidebar.
Says he noticed she was pregnant early to mid 2008. *Yes, I wrote that correctly 2008!  Lee said when he came out of bathroom and Casey was going in, her midsection was showing. Lee said he said something like, "Excuse me...what's that?" and asked his mom if Casey was pregnant because it looked like to him.  SIDEBAR!
Baez corrects him about the years. Referring to 2005. *my daughters birth year!*    Lee said in middle of 2005, when Casey picked him up at airport, noticed it more, was obvious she was pregnant. 

Judge Belvin Perry reprimanded Ashton for objecting before question asked. Told him to sit down!
Right before Caylee was born parents acknowledged Casey was pregnant.  He didn't go to the hospital when Caylee was born because he was hurt. *Casey and Lee get emotional* Says he was angry at Cindy and Casey, because he wasn't included in the revelation even after he asked.  He didn't want to believe it.

Baez patted an emotional Lee's back as he walked off the stand. Lee is comforted by Anthony lawyer and parents.

Cross Examination 
 Asks lee about the trunk photo. Stains pre-existent in trunk? Answers yes. JA: The large stain in center of trunk, about size of basketball, was not there when you owned it? LA: No, don't recall it JA: And car didn't stench when you owned it, did it? Lee chuckles and says no.  JA: Were you asked to meet w/ state in prep of your testimony and you declined? LA: Yes.  Lee says he reached out to Baez and had meeting prior to him testifying earlier this week.  LA said he wanted to relate some information he learned to Baez.   Ashton asks Lee to read his July 2009 depo about Casey's pregnancy (what he called "the bump"). Asked if he called her out on it.  Lee said it wasn't his place to do it. JA: So in July 2009 didn't call her out, but today you say you did? 

JA: Your parents were excited about pregnancy? LA: Couldn't tell you. JA: No preps in home for baby? LA: Don't know.  JA: Your parents were over the top, weren't they? LA: I was told let it go, was angry about it, so didn't participate.  JA: In depo, discuss period of pregnancy before Caylee born? Yes JA: Indicate you felt your role was to be background support? Lee said in depo he was background support, that grandparents were over the top about the baby coming.  JA: What all did they do? LA: Crib, not sure what all. JA: They converted comp room to Caylee's room? LA: Yes.  JA: You were there, lived there before Caylee born? LA: Yes. JA: You knew mom went nuts w/Pooh decor, getting it ready?  Lee says he didn't even walk into the room til after she was born. JA: And your mom & Casey shopped, had shower? LA: If so, not invited.  JA: Aware of them having shower? LA: In June. JA: Invited their friends, Casey's friends, had a party?LA:  I wasn't invited, no knowledge.  Lee said he felt either it was being hidden from him or that he wasn't part of, so wasn't an attentive potential uncle.  JA: Parents weren't hiding it from loved ones, invited them to party? Objection/sustained  JA: Did you cry during that portion of depo (when asked if at hospital for birth)? LA: Don't recall, don't think so.  JA: So what was different about the question 2 hrs ago?   LA: 2 yrs ago, did not 100% believe she was dead. During 2 yrs since, come to know she is. Emotions are from regrets. JA: You spoke at memorial for Caylee Jan 2009, 6 mos before this depo? Yes, I did. JA: Nothing further.

JB: You were asked about basketball size stain in trunk. Do you see one in photo? LA: Not size of Basketball, no.  JB: See white powder there? LA: Yes, that's not what I'd consider stain. Lee telestrating stains he did notice again.  JB: See your mother use entire bottle of Febreze? LA:Never. JB: See LE spray trunk with BlueStar? LA: No, don't know what that is.  JB: Did you meet with defense anytime prior to trial? Let me rephrase. Meet with defense prior to testifying against sister? LA: No.  JB: Advise us of any testimony you were going to give against sister? LA: No. JB:Testifying truthfully for state? Objection.
JB: Ashton said parents over the top happy prior to Caylee being born. Is that what you testified to in depo? LA: Believe so.  Lee says his mom wasn't happy Casey was having a baby out of wedlock. He doesn't know if shower was before/after Caylee born.  Baez mentions is sitting in court room different from sitting in state attorney's office. Tells Baez he cried 2 hours ago because he doesn't want his family to go through this and he doesn't want to be here. It is extremely difficult for him.  At memorial for Caylee, he didn't want to believe that she was really dead.

JA: Remember when you testified for state? LA: Yes. JA: How many times did Mr. George (prosecution)  have to refresh memory with depo? LA: Probably as many times as today. JA: In direct by JB, did you need to refresh? LA: Don't believe so. Recall was fine for JB?

The Judge talks to jury about the hawk who hangs outside window after eating his lunch. Makes noise.

Cindy Anthony
Caylee's baby shower was on the 27th of August.  She got annoyed with Baez at this moment.  It was held after she was born because Caylee came a month early.  JB: When was Caylee's shower? CA: Was supposed to be Aug 13, but Caylee born on 9th, so postponed.  Baez wanted Cindy to identify a photo. State objects. SIDEBAR! Objection sustained.
*Cindy seems more annoyed with Baez today. What happened Cindy? Everyone knows you're a liar, now!?*
Family and friends attended baby shower. Casey's ex-fiancee mother was also there. No guys were present.

Ryan Eberlin: OCSD 
On July 15, 2008 dispatched to Anthony home. Mason asked if he noticed odor when looking at Pontiac Sunfire. He says no.  He handcuffed Casey Anthony and was instructed to remove them by  Sergeant Hosey.

Cross Examination
She was handcuffed for 2-3 minutes and allowed to be free.  She was handcuffed because Cindy informed him that Casey had stolen from her. Objection. Hearsay. Prosecution says door was opened. Mason calls sidebar.  That makes 11!

* So they don't want jury to hear why she was handcuffed but they still brought this guy in!? SMART MOVE BAEZ!*
 Brief legal matter-jury excused

Resume questioning without jury
Deputy says Casey stole credit cards and Cindy wanted to press charges against Casey.  When she was placed in the car, Sergeant Hosey told him they were concerned about the kidnapping, not the credit cards.  That was about 1:30 am; Melich arrived about 3:30-4:00 a.m. This happened before Corporal Melich arrived.


Judge Perry: Defense opened the door. The court will fashion a jury instruction to deal with this.
Jury brought in: Judge reads proposed instruction saying testimony is to explain why deputy did what he did; defendant not on trial for those acts.

LDB asks the same question and deputy gives the same response he did when jury was not present
 Melich did not see this exchange. Once he arrived,deputy was not involved anymore with Casey regarding statements after this day.

Mason: Do you know a Linda Tinnelli(?). Yes, I do. LDB objects. Sidebar.

Jury removed again.

Mason makes proffer. Know Linda Tinnelli? EE:Met her through the case, yes. Was brought to his attn by TexasEquuSearch volunteer. {Texas EquuSearch is a volunteer group that helped searched for Caylee} Says Tinnelli was volunteer at KidFinders tent, kept the volunteer sheet or something.  CM: Ask her about duct tape? EE: Yes, saw footage from local station. EE:Was told she said someone brought duct tape from home. Edwards went to her home - asked her about bugging a lamp and tape conversation she (Tinelli) would have with George and Cindy Anthony.  Edwards said they may also have asked Tinelli to wear a wire.  CM: Aware of any VM msgs left on Tinnelli's phone by GA? EE - I believe it was Cindy Anthony who left msg.  CM: Recall what was said? EE: Not comfortable trying to say w/o the transcript of call.

Judge asked what relevancy does this have to theory of defense? Mason mumbled something and Judge Perry said "part 2 of this question:..." and mentioned the same question again!
CM: Reveals focus of investigation not only on defendant but others. Judge: Relevancy to theory? CM: Dysfunction after drowning and who did what to try to cover up.  Judge: Able to get incriminating evidence? CM: No, she declined to do it.  LDB: Obvious from proffer, sidebar it's designed only to get jury to speculate on LE motive.

Mason mumbles some more arguments to Judge and Judge Perry responds with "I think I have enough experience to know what goes to an argument."

This particular evidence does not go to theory of defense. Deputies testimony will not be heard. BAM POW KABOOM! TAKE THAT DEFENSE!

Judge says jury is being sent out on a "pop tart route" Wants to deal with things now before jury enters. Has no idea who the next witness is and what she is going to testify about.

LDB: Apparently, only evidence from witness will be saw George Anthony with duct tape of some kind that wasn't identified. We'll object. Judge says it doesn't go to admissibility but to the weight jurors want to give it.

She says there was duct tape. They would tape tablecloths onto the table (windy) Also tape missing posters up with tape.

Yuri Melich-Lead investigator -recall
JB:When called out, made aware of smell from car early on? YM:As I said before, at some point someone mentioned it. JB:George? YM:Yes. JB:Didn't do anything with the info? YM:Not til later that day. We had car brought in later on the 16th.  JB:GA wanted to speak privately? YM:Don't know what he wanted, but talked to him as pulling out of driveway.
Melich left the home around 7 a.m., met back with her around noon at Universal Studios. Confiscated car after her arrest.  Melich says she was arrested for elements of crime but he was ALSO worried about her harming herself.  JB:After arrest, the investigation was focused on the car? YM:: Our focus was the missing child, and the also the car.  Melich said it took a while for them to discover that Zanny did not exist. Casey kept talking about Zanny while she was in jail.  JB:Told by everyone in home child went missing June 9, including by GA? YM: Correct. JB: Correct date June 16? YM:Yes Melich didn't know any of the Anthony's before this. Subpoenaed cell phone records of Casey, home phone, George's later on.  Metropolitan Bureau of Investigation helped triangulate cell records for Casey . Not others in Anthony family.  Melich says he only focused in on Casey 's cell phone records early on. Later he says he did Roy Kronk's as well.  Melich interviewed Roy Kronk after the discovery of the remains. Questioning turns to Roy Kronk.Sidebar.
Kronk called in tip about Suburban Dr. Melich told another deputy to move on because it was "vague" and area had already been checked out.  Melich says he has never seen duct tape with a stamp or logo on it, so that it was unusual to him.  JB: You've never asked George Anthony about when and where he got the duct tape? Objection, sustained.  Baez asks if Melich ever went back to ask George Anthony where duct tape with  Henkel markings was? Melich says he didn't. Similar duct tape found in the Anthony home, on the gas cans.  Baez asks if he determined gas can (with tape on it) was the can reported missing? He is looking at the can. The duct tape has since been removed.  Melich is looking up when cans were collected. He thinks it was days within being told about George and Casey fight (over cans).  Obtained statements from Roy Kronk's employers, friends. Took phone records in December but never took his computer.

Cross Examination
Melich answered questions about a "general tip" given to him by homicide detective.Was told location  body was and where search dog had sniffed.

Jury excused for the day. Will resume tom. @ 9:00
JP: When is best guestimate to wrap up? Baez: Weds or Thurs. State thinks rebuttal case should take 1-2 days. JP: Only one lawyer will speak during rebuttal argument.What's the guestimate for closings? You can speak until you get tired or until the jury goes to sleep."
Judge Perry will likely give an order on Monday regarding closing arguments. 
JB:We only have 2 weeks of phone records for Roy Kronk, Melich says he has months worth.  Baez says he is "quite shocked" to hear Melich did inquire phone records of Kronk and George Anthony.  Baez says if true it's a violation. Linda Drane Burdick says she is not aware of any discovery violation. She thinks they were included on a disc.  She  also says there was a court order on cell phone records to avoid a "fishing exhibition" (during Strickland days).
 JP: If you need records, then try to get them, but its a little late in the day to going after red herrings. 

William Rodriguez is brought up.
Baez says the Dept of Defense called Ashton. Ashton says he didn't reach out to DoD. Ashton says a Capt solicited him. Next thing Baez knew Dr. William Rodriguez  did not want to testify because he was told he would be fired if he did.  Baez says they will file a motion concerning this. Ashton says "bring it on""We will" was Baez' response!

Judge Perry said either we tell the jury the complete story, or we tell them to disregard his testimony and not speculate. Judge said he will find out if Rodriguez sought permission from Dept of Defense. JP said he's trying to decide whether to send the jury out for deliberations Friday evening, or have them fresh Saturday morning next week.
Judge read all the lesser counts against Casey. He said instructions for the jury will take about 45 minutes. Judge said jurors will be separated from one another once they get the case.
*Casey just zoned off during this whole transaction. Seems like it's FINALLY getting to her!*
Judge says an evidentiary hearing will happen either in the morning for 30 min or later. He says he will not interrupt trial.

Ashton walks over name/number of DoD Captain who called him. He slammed it down on defense table. Baez shrugged his arms and looked at him.

Caylee's skull and other pictures are shown



Lee Anthony

-after Casey was released from Jail the first time, Casey told him Zany and her sister forcibly took Caylee away from her @ Jay Blanchard Park becasue she was a bad mom and they were going to teach her a lesson.
-Zany held her down by her wrists
-He did search for Sawgrass Apts. and Zenaida Fernandez-Gonzalez after Casey told him what happened when he first spoke to her
-Zany was 100pds., dark complexioned, medium height, and Hispanic

Cross Examination
-Zany would contact through Myspace and tell Casey how to act and where to go and maybe see Caylee
-No, Zany the Nanny never materialized.

Stephen Hanson:
-His hands are seen picking up skull.
-Hanson is the chief investigator for the Medical Examiners office.
-Hanson is reviewing more pictures.Casey is looking up now but looks down when a pic is about to be published.
-Hanson is looking at pictures of the wooded area- moving into the path where remains were recovered.
- Hanson looks directly at jury and talks about trying to preserve anything and everything that could be important to a crime scene.
-Hanson says they were hoping and thinking there were more remains (bones) inside the bag (black plastic bag)
-Hanson says as medical Examiners office they control the remains while Sheriff's office controls crime scene.
-Hanson uses his own head (he is pretty much bald) to show jury what exactly they are looking at.
-Hanson says he went about 6-8 inches to the side and went down as far as he could and scooped it (skull) up to a brown paper bag.
-Hanson says they also collected canvas bag and black plastic bag as wellness 2 other large bones in area.
-Hanson says he didn't know at the time of collection the shorts were actually shorts. Also collected what was believed to be a blanket.
-Hanson says his last trip to crime scene was Dec 17, 2008 he went to gather things he thought were remains.
-Cheney Mason steps up for cross examination.
-Mason points out a picture where it looks like someone cut a path through some underbrush.
-In this photo it looks as if a machete is stuck in the ground.
-Mason makes a joke about being technologically challenged - tells Burdick to "stand right there" jury laughs
-Ashton stood up and objected loudly asking for a sidebar. He even started heading in that direction. Judge said no.


-Mason asks if Hanson knows if someone moved skull. Ashton objects and moves to strike. Stricken.
-Mason asks when Hanson "scooped" everything up if duct tape could have changed positions. Hanson says "it could have"
-During that joking period Linda Drane Burdick wasn't amused -she said "I don't work for you" when Mason joked "stand right there."
-No redirect. Hanson is excused.

-Utz says the canvas and black plastic bags all came together w/ fabric (blanket) and debris. skull in sep bag.
-The next pic is of the bag opened up. They are zooming in on a leg bone.
-Next photo is skull/ tape/leaves at the morgue. They ripped the brown evidence bag open.
-The pic is of an upright skull. You can see hair wrapped around it. The tape there looks like it's sitting in front of what would be mouth

-Utz says roots had grown into and around the hair mat. Some hair had to be cut to preserve tape.
